The complaint alleges TDS required Network Specialists to work overtime in order to complete all their work but failed to pay overtime pay for the overtime hours worked.

SAN FRANCISCO, CA, February 05, 2024 /24-7PressRelease/ — On January 22nd, 2024, a former employee of TDS Telecom initiated a lawsuit alleging the company misclassified its Network Specialists as salaried exempt and did not pay overtime.

According to Complaint, the Named Plaintiff alleges the primary job duties of a Network Specialist (I, II, and Senior) consist of communicating with TDS Telecom’s contracted vendors and construction companies regarding project design plans, entering design data for cost auto-calculation, obtaining the necessary permits for construction, and submitting project plans to Defendant’s managers and oversight board for approval. The Complaint further alleges TDS Telecom assigned Network Specialists heavy workloads and required them to work overtime in order to complete all their work but failed to pay overtime pay for the overtime hours worked.

The lawsuit is filed as a putative collective action under the federal Fair Labor Standards Act (“FLSA”) and a putative Colorado Rule 23 class action under Colorado state law. The action seeks to recover unpaid overtime compensation and liquidated (double) damages for the workers impacted by TDS Telecom’s job position misclassification.
